BIKE ARENA ZERMATT 

**TERMS AND CONDITIONS**

1. **Scope**

The bike rental service is provided by Bike Arena Zermatt GmbH (hereinafter referred to as "the Lessor") based in Zermatt, which owns the rental bikes. These Terms and Conditions are an integral part of the rental contract. By signing the contract, the Renter confirms having read, understood, and unconditionally accepted these rental conditions. There is no distinction made between bikes with or without electric drive. These Terms and Conditions cover all bikes, hereinafter referred to as "bikes".

2. **Contractual Relationships**

The contract is concluded between BAZ and the customer.

3. **Bike Collection**

The Renter takes over the bike in a roadworthy and clean condition. Any complaints by the Renter must be reported to the Lessor at the time of bike collection. The Renter must present an official document for identification (identity card, passport, driver's license).

4. **Bike Return**

The Renter is obliged to return the bike to the Lessor before the rental period specified in the rental contract expires. The rental price for late returns and any resulting consequential costs will be charged to the Renter. The bike and all accessories provided by the Lessor (helmets, backpack, battery, protectors, navigation device, etc.) must be returned in full and in perfect condition. Loss or damage will be charged to the Renter. Rental equipment must be returned within opening hours unless otherwise agreed. If this is not possible, the shop must be informed immediately, and additional costs may apply.

5. **Extension of Rental Period**

An extension of the rental period is only possible with the Lessor's consent before the current rental period ends. The Lessor may refuse an extension without giving reasons. The rental price will be recalculated, and the additional cost must be paid at the latest upon bike return.

6. **Minimum Age of the Renter**

Children and adolescents under 16 must be accompanied by an adult. For children and adolescents under 16 not accompanied by an adult, rental bikes may only be provided with written permission from parents or guardians.

The minimum age for riders of an e-bike with support up to a maximum of 25 km/h is legally 16 years (14 years with a moped license).

7. **Services and Prices**

The prices applicable at the time of rental and published on the Lessor's website apply, including the discount provisions contained therein. Printing errors excepted. Any discounts are granted on-site and are not cumulative.

8. **Cancellation / Termination**

Up to 48 hours before the rental start, a free cancellation is possible. Until 12:00 noon the day before the rental start, a processing fee of 30% of the final rental price as per the rental confirmation will be charged. From 12:00 noon on the day before the rental start, we charge 80% of the total amount as per the rental confirmation. In case of rental termination, there is no entitlement to a refund of the unused rental period.

9. **Liability and Insurance**

   9.1 **Liability Insurance**

Insurance is the responsibility of the Renter. By concluding the rental contract, the Renter confirms having liability insurance and sufficient coverage for the risks associated with riding a bike or e-bike. Liability extends to damage costs such as expert fees, depreciation, or rental loss costs.

   9.2 **Defects During Rental Period**

In the event of defects during the rental period, the Renter can exchange their bike at BAZ for an equivalent bike, provided one is available.

   9.3 **Damage, Theft, and Loss**

The Renter must report any damage or loss to the Lessor.

The Renter is liable for all damage to the rental object and its accessories caused during the rental period by falls, vandalism, natural events, manipulation, transport, and improper or inappropriate use.

The cost of minor damage and material loss will be charged to the customer at BAZ Bike Shop and its workshop prices.

In case of theft or loss of the rental object or accessories during the rental period, the Renter is liable. The bike must always be secured. The loss will be charged to the Renter at the replacement value.

If the Renter transfers the bike to third parties, they are generally liable for damage and consequential damage caused to the bike by third parties.

   9.4 **Accidents**

Accidents and falls causing property damage must be reported to BAZ immediately. If people are injured and/or third-party property is damaged, or a third party is involved as a possible co-cause, the police must be called immediately, and an accident report must be completed. A copy of this must be sent to BAZ.

10. **Usage / Prohibitions**

The Renter undertakes to comply with traffic regulations and to use the bike properly and carefully.

The Renter is responsible for all damage resulting from negligence or improper use of the rental object or third-party objects. Any misuse of the bikes, transporting additional persons, or riding over obstacles that could obviously damage the bike is not permitted.

The use and wearing of the provided helmets are mandatory for e-bikes. The Lessor disclaims any liability in this regard.

11. **Products, Services, and Prices**

Product illustrations in advertising, brochures, online shops, etc. are for illustration purposes only and are non-binding.

All published sales prices in the online shop are final prices including taxes (especially VAT), but excluding any advance recycling fees (vEG), packaging costs, delivery costs, and other charges.

Bike Arena Zermatt reserves the right to change the prices of the offered products and services at any time. The price at the time of the order in the online shop is decisive for the purchase contract. In the case of double sales or bookings, Bike Arena Zermatt reserves the right to decide when and to whom it delivers the goods or rental equipment and to refund the other party via bank transfer.

12. **Applicable Law and Jurisdiction**

BAZ strives to resolve disputes out of court. If the parties cannot reach an agreement, legal action will be taken. This contract is governed by Swiss law. The exclusive place of jurisdiction is Zermatt (VS).
